These Website Terms and Conditions ("Terms") govern your access to and use of comfortcarepa.com, including its webpages, forms, content, features, and related online services (collectively, the "Website"). The Website is owned and operated by Comfort Home Care, Inc. ("Comfort Home Care," "we," "us," or "our"). By accessing or using the Website, you agree to these Terms. Do not use the Website if you do not agree with them.

1. Website Purpose

The Website provides general information about Comfort Home Care, available home-care services, employment opportunities, community activities, locations, and methods of contacting us.

Website information does not replace a written service agreement, care plan, employment agreement, program authorization, insurance determination, or other formal documentation.

2. Eligibility

You must be legally capable of agreeing to these Terms.

If you use the Website on behalf of another person, organization, or legal entity, you represent that you have authority to act on that party's behalf.

The Website is not directed to children under 13.

3. Acceptable Use

You may use the Website only for lawful, personal, and legitimate informational or business purposes.

You may not:

  • Violate any applicable law or regulation
  • Submit false, misleading, fraudulent, or unauthorized information
  • Impersonate another person or misrepresent your identity or authority
  • Attempt to gain unauthorized access to the Website, servers, accounts, systems, or data
  • Interfere with Website performance, availability, or security
  • Introduce malware, viruses, harmful code, automated attacks, or disruptive technologies
  • Scrape, crawl, harvest, extract, reproduce, or index Website data through unauthorized automated means
  • Use Website content to create a competing database, directory, or service
  • Circumvent access restrictions or security controls
  • Use the Website to harass, threaten, exploit, or harm another person
  • Submit unlawful, defamatory, discriminatory, infringing, obscene, or malicious content
  • Use contact information from the Website for spam, unauthorized marketing, or solicitation
  • Assist another person in performing a prohibited activity

We may restrict or terminate access when we reasonably believe these Terms have been violated.

4. Website Forms and Communications

You agree that information submitted through the Website will be accurate and that you have the legal right to provide it.

Submitting a form authorizes Comfort Home Care and its representatives to respond using the contact information provided, subject to applicable law and your communication preferences.

Submitting a form does not guarantee:

  • Acceptance as a client
  • Availability of services
  • Eligibility for a program
  • Insurance authorization
  • A particular caregiver or schedule
  • Employment consideration
  • An interview or job offer
  • A response within a specific period

General Website forms and ordinary email may not provide secure transmission for sensitive medical, financial, or identity information.

5. No Emergency Use

The Website must not be used for medical emergencies, urgent health concerns, immediate safety threats, or time-sensitive care issues.

Call 911 or contact an appropriate emergency service when immediate assistance is required.

6. Intellectual Property

The Website and its content, including text, graphics, photographs, videos, logos, icons, page designs, software, downloads, and branding, are owned by or licensed to Comfort Home Care and are protected by applicable intellectual-property laws.

Subject to these Terms, you may access and display Website content for personal, noncommercial, informational use.

You may not copy, republish, distribute, modify, sell, license, publicly display, create derivative works from, or commercially exploit Website content without prior written permission, except as permitted by law.

7. Trademarks

Comfort Home Care's names, logos, service names, slogans, and branding are trademarks or proprietary identifiers of Comfort Home Care.

Third-party names and trademarks appearing on the Website belong to their respective owners. Their appearance does not necessarily indicate sponsorship or endorsement.

No license or right to use any trademark is granted by your use of the Website.

8. User Submissions

If the Website allows you to submit messages, documents, comments, photographs, reviews, applications, or other content, you represent that:

  • You have the right to submit the material
  • The material is accurate to the best of your knowledge
  • The submission does not violate another person's privacy, intellectual-property, contractual, or legal rights
  • The submission does not contain malicious code or unlawful material

You authorize Comfort Home Care to use and process submissions as reasonably necessary to respond, evaluate requests or applications, maintain records, operate the Website, protect legal rights, and conduct legitimate business activities.

This provision does not transfer ownership of confidential records or protected health information and does not override applicable privacy laws.

9. Employment Submissions

Submitting employment information or an application does not create an employment relationship or guarantee consideration, an interview, an assignment, or an offer.

Comfort Home Care may verify submitted information and may require additional documentation, qualifications, screenings, clearances, certifications, or authorizations as permitted by law.

Any employment relationship will be governed by separate written policies, documentation, and applicable law.

10. Service Information

Website descriptions of home-care services are general and may change.

The actual scope, availability, schedule, location, authorization, payment terms, and conditions of services will be determined through applicable assessments, care plans, program requirements, and written agreements.

Website content does not guarantee that a particular service is appropriate or available for any person.

11. Third-Party Websites and Services

The Website may contain links, integrations, maps, videos, social-media features, or other services provided by third parties.

We do not control these third parties and are not responsible for their availability, accuracy, privacy practices, security, content, products, or services.

Your use of third-party services is governed by their own terms and policies.

12. Privacy

Our collection and use of personal information through the Website are described in our Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Website is provided on an "as is" and "as available" basis.

Comfort Home Care disclaims all express and implied warranties relating to the Website, including warranties of:

  • Accuracy
  • Completeness
  • Availability
  • Reliability
  • Security
  • Noninfringement
  • Merchantability
  • Fitness for a particular purpose

We do not warrant that the Website will be uninterrupted, error-free, secure, or free from harmful components.

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.

14. Limitation of Liability

To the fullest extent permitted by law, Comfort Home Care and its owners, directors, officers, employees, affiliates, contractors, agents, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

  • Use of or inability to use the Website
  • Reliance on Website content
  • Website errors, interruptions, or security incidents
  • Unauthorized access to communications or submissions
  • Third-party websites, content, products, or services
  • Conduct of another Website user

These limitations apply regardless of the legal theory asserted and even when the possibility of damages was known or reasonably foreseeable.

Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Comfort Home Care and its owners, directors, officers, employees, affiliates, contractors, agents, and representatives from claims, liabilities, damages, judgments, losses, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the Website
  • Your violation of these Terms
  • Your violation of another party's rights
  • Content or information you submit
  • Fraudulent, misleading, or harmful conduct connected with your Website use

16. Suspension and Termination

We may suspend, restrict, or terminate access to all or part of the Website at any time when reasonably necessary for maintenance, security, legal compliance, operational needs, or suspected violations of these Terms.

Provisions that logically should remain effective after termination will survive, including intellectual-property protections, disclaimers, liability limitations, indemnification obligations, and governing-law provisions.

17. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

Subject to any applicable legal restrictions, claims arising from the Website or these Terms will be brought in a state or federal court with appropriate jurisdiction serving the county in which Comfort Home Care's principal Pennsylvania office is located.

You consent to the jurisdiction of those courts.

18. Changes to the Website or Terms

We may update the Website and these Terms periodically.

Revised Terms become effective when posted unless another effective date is stated. Continued use of the Website after revised Terms are posted constitutes acceptance of the updated Terms.

19. Severability

If a provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or removed, while the remaining provisions will remain effective.

20. No Waiver

Failure to enforce a provision of these Terms does not waive our right to enforce it later.

A waiver is effective only when made in writing by an authorized representative of Comfort Home Care.

21. Entire Agreement

These Terms, together with the Privacy Policy and Website Disclaimer, constitute the entire agreement concerning use of the public Website.

They do not replace separate service, employment, confidentiality, healthcare, insurance, or vendor agreements.
